These terms are the agreement between you and Position Games Limited (“we”, “us”), a company registered in Ireland, covering your use of the Central Station app on iPhone, iPad, Mac and Apple TV.
By installing or using the app you accept these terms. If you do not accept them, please do not use the app.
These terms replace Apple’s standard licence agreement. Apple is not a party to them, and is not responsible for the app or for anything shared through it.
Central Station controls a Märklin Central Station 2 or 3 over your own local network. It is an independent product. We are not affiliated with, endorsed by, or sponsored by Gebr. Märklin & Cie. GmbH; Märklin, CS2 and CS3 are trademarks of their respective owner.
The app also lets you share model-railway track plans with other users. Sections 3 to 6 apply to that feature.
We grant you a personal, non-transferable licence to use the app on devices you own or control, as permitted by the App Store Terms of Service. You may not sell, rent, sub-licence or redistribute the app, nor attempt to derive its source code except where law expressly allows it.
The app can publish track plans to a gallery other users can browse. You do not need an account: your device generates a key that identifies your contributions. See our Privacy Policy for what that involves.
Anything you publish is public. It can be viewed and downloaded by anyone using the app.
You keep ownership of what you publish. By publishing it you grant us a non-exclusive, worldwide, royalty-free licence to host it and to make it available to other users through the app, for as long as it remains published.
You confirm that you have the right to share what you publish, and that doing so does not infringe anyone else’s rights.
We have zero tolerance for objectionable content and for abusive behaviour. You must not publish, or use the app to distribute, anything that:
Display names are subject to the same rules. They are not verified or reserved, and we may change or remove one that breaches these terms.
Every shared track plan can be reported from within the app, and you can block a publisher so that their content no longer appears for you.
We review reports within 24 hours. Content reported by several different people is hidden automatically while it is checked. Where a report is upheld we remove the content and, for repeated or serious breaches, we bar the publisher from sharing further.
You can also write to support@positiongames.com. If you believe something infringes your copyright, tell us what it is and where, and how we can reach you.
You can delete anything you have published, at any time, from inside the app.
You can also withdraw from the gallery entirely. When you do, your publisher record and your likes and blocks are deleted. By default your published track plans stay in the gallery but are no longer credited to you — the app tells you this before you publish anything. If you would rather they were deleted outright, you can choose that when withdrawing, or ask us.
The app sends commands to model railway equipment, which moves physical objects. You remain responsible for operating your layout safely and for supervising it while it is running. Do not rely on the app as a safety mechanism.
The sharing gallery is provided as it is, and we may change, suspend or discontinue it. Track plans you have saved on your device are unaffected: the app stores them locally and can export them as files, so your own work never depends on our server being available.
You may stop using the app at any time by deleting it. We may suspend or end your access to the sharing gallery if you breach these terms, in particular section 4.
The app is provided “as is”, without warranties of any kind so far as the law permits. We do not warrant that it will be uninterrupted or error-free, or that it will work with every configuration of equipment.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability arising from the app is limited to the amount you paid for it.
Nothing here affects your statutory rights as a consumer.
We may update these terms. The effective date at the top shows when they last changed, and continuing to use the app after a change means you accept the revised terms.
These terms are governed by the laws of Ireland, and the courts of Ireland have jurisdiction. If you are a consumer resident elsewhere in the EU, you keep the protection of the mandatory laws of your country of residence.
